Married With Children

If you are married and with children your estate plan may seem to be fairly straight forward. You want all your assets to go to your spouse and then to your children when your spouse passes on.  However this plan does not ensure that your family will stay out of court. You need to have a plan in place that takes into account life’s unforeseen events and ensures your family receives what assets you want them to have and when, and that your wishes are followed.  If you have children equally important is that you ensure your children have a guardian named who will take your place and raise your children in accordance with how you would have done so. Without a proper estate plan in place, your children’s guardian may be appointed by the courts and your wishes and interests in how your children are raised will not be known.  If your children are over 18 years old, equally important is ensuring they have appointed either you are someone they trust as healthcare and durable power of attorney. In event they are incapacitated you want to ensure you or their trusted partners are able to speak with their medical professionals and handle their financial affairs.
